The accident occurred on Interstate 55 near Imperial when Cundiff’s 62-year-old client was struck from behind by another vehicle. The two cars skidded into the concrete median, bounced back into each other, and then bounced into the median again.

The defense claimed that both vehicles involved were close to the line and collided into each other, but through an investigation of the scene and property damage and with the testimony of another driver during the crash, the plantiff was successfully able to prove that he was not liable for the crash.

During the accident, the plantiff suffered a tibial plateau fracture in the knee. Doctors said that the injury would eventually lead to a joint replacement. As his foot began to give him more trouble, specialists diagnosed degenerative disease in at least two of his toes and an irritated nerve bundle which would need surgery. These injuries and the degeneration in the victim’s big toe were linked to the car accident by a foot and ankle expert.

Attorney Brad Cundiff was able to successfully prove that his client was in his lane during the accident and that his injuries were directly linked to the event of the crash, earning an $800,000 verdict for his client.
